2. QUALIFYING JOB POSITIONS
Executives, Senior managers and Specialized knowledge workers, are job positions eligible for work permit.
The first group includes individuals in the executive or managerial categories.
Executive means that the employee primarily:
Directs the management of the organization or a major component or function of the organization;
Establishes the goals and policies of the organization, component, or function;
Exercises wide latitude in discretionary decision-making.
Managerial means that the employee primarily:
Manages the organization, a department, subdivision, function, or component of the organization;
Supervises the work of other managers, supervisors and professional employees;
Exercises discretion over the day-to-day operations of the activity, or function, for which the employee has authority.
The second group includes individuals in the specialized knowledge category.
Specialized knowledge workers must demonstrate an advanced level of knowledge or expertise in the organization’s processes and procedures (product, process and services can include research, equipment, techniques, management or other interests).
Some characteristics of a worker who has a specialized knowledge are:
Possesses knowledge that is valuable to the employer’s competitiveness in the market place;
Uniquely qualified to contribute to the Canadian employer’s knowledge of foreign operating conditions;
Knowledge has been gained through extensive prior experience with the employer.
The intra-company category was created to permit international companies to temporarily transfer qualified employees to Canada for the purpose of improving management effectiveness, expanding Canadian exports and enhancing the competitiveness of Canadian entities in overseas markets.
